MARJINALISASI HAK POLITIK PENYANDANG DISABILITAS Pada ayat 3 berbunyi: “Special measures of protection and assistance should be taken on behalf of all children and young persons without any discrimination for reasons of parentage or other conditions. Children and young persons should be protected from economic and social exploitation. Their employment in work harmful to their morals or health or dangerous to life or likely to hamper their normal development should be punishable by law. States should also set age limits below which the paid employment of child labour should be prohibited and punishable by law”. Variasi lain dalam melembagakan istilah pelayanan khusus bagi kelompok masyarakat tertentu, dirumuskan dengan istilah special care sebagaimana dijumpai pada artikel 25 ayat 2 pada UDHR yang berbunyi: “Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection”. Dalam artikel 22 Konferensi Wina A/CONF.157/ 23 tertanggal 14 sampai 25 Juni 1993 menggunakan istilah special attention needs, sebagai cikal bakal lahirnya istilah kelompok berkebutuhan khusus yang perlu mendapat perlindungan lebih atau perlakuan khusus. Hal tersebut selengkapnya berbunyi: “Special attention needs to be paid to ensuring non-discrimination, and the equal enjoyment of all human rights and fundamental freedoms by disabled persons, including their active participation in all aspects of society”. Frase “special needs” yang banyak disebut sebagai istilah terpopuler untuk menggantikan istilah PD di Indonesia, terdapat pada artikel 23 konferensi Wina A/ CONF.157/ 23 tertanggal 14 sampai 25 Juni 1993 yang selengkapnya berbunyi: “Primarily through the preferred solution of dignified and safe voluntary repatriation, including solutions such as those adopted by the international refugee conferences. The World Conference on Human Rights underlines the responsibilities of States, particularly as they relate to the countries of origin”. Dalam preambule point (j) International Convention on The Rights of Person With Disability, resolusi PBB No. 61/106 tertanggal 13 Desember 2006 istilah “perlindungan lebih” bagi PD dirumuskan dengan frase “more intensive support”. Hal tersebut selengkapnya berbunyi: “Recognizing the need to promote and protect the human rights of all persons with disabilities, including those who require more intensive support”.
