CHAPTER II ORDER OF APPOINTMENT AND DISMISSAL OF THE HUMAN RIGHT OMBUDSMAN Article 4. Appointment for the post of the Human Rights Ombudsman The Human Rights Ombudsman shall be appointed for the post by the President of the Republic of Tajikistan upon agreement of Majlisi Namoyandagon of Majlisi Oli of the Republic of Tajikistan. Article 5. Requirements to nominee for the post of the Human Rights Ombudsman Any citizen of the Republic of Tajikistan aged not younger than 35 years old who has higher legal education, high professional and moral characteristics may be appointed for the post of the Human Rights Ombudsman. Article 6. Assumption of the post of the Human Rights Ombudsman After assuming the post, on the meeting of Majlisi Namoyandagon of Majlisi Oli of the Republic of Tajikistan the Human Rights Ombudsman shall swear an oath of the following content: "I swear to defend the rights and freedoms of person and citizen, to fulfill conscientiously duties of the Human Rights Ombudsman charged on me, governing by the Constitution and legislation of the Republic of Tajikistan”. 2. The Human Rights Ombudsman shall assume the post after swearing an oath. Article 7. Term of office of the Human Rights Ombudsman 1. The Human Rights Ombudsman shall be appointed to the post for a term of five years. He shall not take this position for more than two terms in succession. Term of office of the Human Rights Ombudsman shall be calculated from the day of the pronouncement of the oath. Term of office of the Human Rights Ombudsman shall be ceased on the day of the pronouncement of the oath by a newly appointed Human Rights Ombudsman 2. Appointment of the Human Right Ombudsman shall be reported in mass media. Article 8. Immunities of the Human Rights Ombudsman 1. The Human Rights Ombudsman shall be inviolable. He shall not be arrested, detained, brought by force or searched without agreement of the body appointed him on this position, save in cases where he or she was caught red-handed.
