Probation and community correction - the Department of Prison, Malaysia
has recorded a recidivism rate of 0.44% among parolees who had served their
sentence in their community as compared to 15% of inmates who had
undergone rehabilitation in the prison until the end of their sentence. The
Department of Prison, Malaysia wishes to expand its rehabilitation into the
community through the introduction, improvement and expansion of
community correction and probation service.
• The Department of Prison, Malaysia had revised the Compulsory
Attendance Act in 2010 as an alternative to imprisonment for inmates
undergoing sentence below one year and allowing them to serve within
the community without stepping into the prison. The Department of
Prison, Malaysia is looking into broadening the scope of the Compulsory
Attendance Act by amending the act to cater to sentences below three (3)
years by December 2021 and the amendment would be tabled in the
Parliament.
• Another step taken to further advocate community rehabilitation is
through releasing inmates or "liaison" which come under the purview of
and jurisdiction of the Commissioner General of Prison. The release or
liaison is being enhanced and efforts are being taken to increase the
release of inmates. In future, Malaysia intends to implement and to
expand the probation system as an expansion to the community
correction with the assistance of Her Majesty’s Prison and Probation
Service, United Kingdom through the British High Commission in Malaysia.
• The Department of Prison, Malaysia is looking into setting up volunteer
probation officers among social workers and other alternatives to
imprisonment such as home detention, suspended sentence, and prison
supervision to cope with the man power required.
The Department of Prison, Malaysia had identified enabling factors of prison
transformation to complement its five core functions:
i. Empowerment of staff - the recruitment process of prison officers will be
focused on certain criteria related to the correctional field.
• Profiling will be conducted for selection and identification of job
placement.
• Competency level among in-service officers will be enhanced through
exposure and training.
• Encouragement and motivation such as ‘earn and learn’ scheme will be
provided to support junior officers to improve their career path through
the opportunity to further their academic qualification. On the other
hand, exposure and opportunities will be given to senior officers to
acquire knowledge and training with international counterparts such as
Her Majesty’s Prison and Probation Service, United Kingdom (UK).
• Fast track and time-based promotion are implementation to motivate
reward and to enhance the performance and productivity of prison staff.
ii. Infrastructure and facilities - a well-planned and balanced environment will
contribute to the productivity, efficiency, and effectiveness of programmes
