UNITED NATIONS CONVENTION TRANSNATIONAL ORGANIZED CRIME AGAINST India has signed and ratified the United Nations Convention against Transnational Organized Crime and its three additional protocols in 2011. The Additional Protocols are z Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime. z Protocol against the Smuggling of Migrants by Land, Sea and Air, supplementing the United Nations Convention against Transnational Organized Crime. z Protocol against the Illicit Manufacturing of and Trafficking in Firearms, Their Parts and Components and Ammunition, supplementing the United Nations Convention against Transnational Organized Crime. NHRC Guidelines on Custodial Rapes and Custodial Deaths z District Magistrates and Superintendents of Police of every district should report to the Secretary General of the Commission about such incidents within 24 hours of occurrence or of these officers having come to know about such incidents. Failure to report promptly would give rise to presumption that there was an attempt to suppress the incident. z Custodial deaths include the ones in police custody as well as judicial custody. z All post- mortem examinations done in respect of deaths in police custody and in jails should be video-filmed and cassettes be sent to the Commission along with the post-mortem report. z The Commission has on the basis of the U.N. Model Autopsy protocol, has prepared a Model Autopsy form. z For proper assessment of “Time since death” or ‘the time of death’, determination of temperature changes and development of Rigor Mortis at the time of first examination at the scene is essential. This can conveniently be done by following some easily understandable and implementable procedure. 82
