ii. Amended S. 376(3) concerning rape of woman under 16 years of age to include rigorous imprisonment of a minimum twenty years which may extend to life imprisonment. iii. Added S. 376AB concerning rape of a girl below the age of 12. The punishment stipulated includes a minimum twenty years rigorous imprisonment which may extend to imprisonment for life. The offender in such cases can also be punished with death penalty. iv. Added S.376DA for gang-rape of a girl under 16 years of age for which the punishment may include imprisonment for life. v. Added S. 376DB for gang-rape of girls under 12 years of age for which the punishment may extend to life imprisonment. vi. Omitted clause (1) of S.376(2) b. CODE OF CRIMINAL PROCEDURE i. Amended S.438 to ensure that High Court or a Court of Session can no longer grant anticipatory bail for a person accused of rape on a woman of under sixteen years of age. ii. Added proviso to S. 439 of the Code which states that the High Court or the Session Court has to give notice to the public prosecutor within 15 days of which it receives the bail application of an accused of raping a girl under 16 years of age. iii. Added a sub-section to S. 439 which makes the presence of informant or a person authorized by him mandatory during the hearing of bail application of the accused in such cases. c. INDIAN EVIDENCE ACT i. Section 53A and 146 have been amended duly in consonance with the amendments made to other provisions of law. 81
