सव भव तु सिखनः ु The Commission took cognizance in the ma er and considered the report submi ed by the Special Monitor. The Commission issued direc on to the State of Manipur, Ministry of Home Affairs, Government of India, and Ministry of External Affairs, Government of India to submit ac on taken report/ compliance report on recommenda ons including transfer of cases to the Na onal Inves ga ng Agency (NIA). Pursuant to further direc on of the Commission, the Dy. Secretary (PR & ATC), Women Safety Division, Ministry of Home Affairs, Govt. of India vide communica on dated 06May 2022 submi ed the report of DIG (Policy), NIA. It was submi ed in the report that a copy of MHA's Women Safety Divisions le er dated 17 December 2020 enclosing SOP for comba ng trafficking of persons in India issued by NHRC had already been shared with all officers/ officials of NIA for sensi sing them on various aspects of Human Trafficking. Further, direc ons were also issued to concerned branch heads of NIA branch offices located at Imphal, Guwaha , Kolkata, Lucknow and Chandigarh for close liasioning with other sister agencies like SSB, BSF and ITBP for colla ng and analysing informa on/ intelligence pertaining to human trafficking. It was further submi ed that all four FIRs (rela ng to human trafficking racket, registered at State of Manipur) i.e. FIR No. 7 (2) 2019 dated 01 December 2019, FIR No. 14 (2) 2019 dated 01 February 2019, FIR No. 26 (2) 2019 dated 01 February 2019 and FIR No. 25 (2) 2019 dated 02 February 2019 were transferred to the NIA and all four cases were under inves ga on. Further, pursuant to the direc on of the Commission and condi onal summons to the Chief Secretary, Govt. of Manipur, the Under Secretary, Home, Govt. of Manipur vide communica on dated 31 March 2022 submi ed that SOP dated 07 March 2022 was circulated to the concerned departments including districts SPs on comba ng trafficking of persons in India. It was further submi ed that reimbursement of the expenditure incurred by the NGOs involved in cases have been made under the Ujjawala Scheme of the Ministry of Women and Child Development, Govt. of India. Regarding male vic ms of human trafficking by way of rehabilita on, shelter and financial assistance, it was submi ed that as of now, there was no provision for rehabilita on of male vic ms and Govt. of Manipur would explore ways for se ng up shelter homes for male vic ms. Chapter 7 - Thematic Areas The Commission considered the material placed on record. All four FIRs were registered by Manipur Police in connec on with human trafficking of 179 Nepalese ci zens (147 women and 32 men) from various loca ons in Manipur, all scheduled to fly to Middle-East countries. The Women Safety Division, Ministry of Home Affairs, GOI, informed that all four FIRs were transferred to the NIA and all four cases were under inves ga on. Since the law was set in mo on, no further interven on of the Commission was required. The case was closed. 2.) Illegal ac vi es of human organ trade and human trafficking in District Thiruvarur, Tamil Nadu (Case No. 2200/22/51/2021) The Commission received a Complaint dated 29 June 2021 in vernacular language from one resident of District Thiruvarur, Tamil Nadu, about illegal ac vi es of human organ trade and human trafficking to Japan in the area by certain persons. A prayer was made for interven on by the Commission in the ma er. The complainant alleged that one Doctor was causing accidents in different places and helping illegal Organ Trade Racket and smuggling eyes and kidneys abroad and also brainwashing youngsters. The Commission observed that the facts of the case were disturbing. The allega ons made in the complaint were serious in nature, involving human trafficking and trade in human organs having interna onal nexus. The case therefore involved grave viola on of Human Rights of the vic ms and their families. Such types of cases are viewed very seriously by the Commission. In these circumstances, a No ce was sent to the Director General of Police, Tamil Nadu, calling for an independent enquiry and ac on taken report. The Commission took serious view of the non-responsive a tude of Director General of Police, Tamil Nadu, for not filing the requisite report. In these circum- stances, summons were issued in the name of Director General of Police, Tamil Nadu, for his personal appearance before the Hon'ble Commission at 11:00 a.m. on 28 April 2022 along with the requisite reports and copies of relevant documents. In case, the requisite report was received on or before 21 April 2022, personal appearance of the above officer shall stand dispensed with.
