According to the NHRCK's survey in 2010, the key reasons of the immigrant children's school dropout are 'too difficult lessons at school', 'crackdowns on foreigners without a visa', 'disregard from Korean students' and 'the burden to pay school tuitions'. Although some schools make efforts to prevent their dropout, by giving guidance on their school life and providing mentoring and counseling service, many other schools do not make such efforts. 2) Questions 103. What measures does the Government undertake to prohibit immigrant children from being denied admission or transfer to school, strengthen Korean language training for immigrant children and prevent their school dropout? Protection of children in the course of the crackdown on illegal migrant workers 1) Current situation 104. When illegal migrant workers are detected while living with their family, they are brought to a foreigners' shelter for protection before leaving this country. In this case, there are not sufficient institutional arrangements to protect their children. The foreigners' shelters do not take any other alternative measure than taking custody of their children. The Immigration Control Law does not include any particular provisions on treatment of unregistered immigrant children or minimum protective actions for the children in custody, such as humanitarian contacts with their parents. In some cases, unregistered immigrant children are left alone while their parents are in custody. 105. Under the Immigration Control Law, public servants are required to report an offender of the law or a person who is subject to forcible eviction if and when they find such person (public servants' reporting obligation). For this reason, some unregistered migrant workers would not have their children attend to school for fear that their illegal status might be revealed. The Government decided to exempt educational public servants (including teachers) from this obligation and notified all relevant educational institutions of this decision. However, it is not widely known yet to school teachers or migrant workers. 2) Questions 106. Does the legislation concerning immigration have a separate provision on protection of the human rights of immigrant children?
