Annual Report 2016 NHRC considered that it was a violation of human rights as well as the constitutional rights. In Bangladesh, it is not mandatory to own property for being a citizen of the country. But the process of police verification in respect of the two victims did not consider it and they were not finally selected for the job. NHRC took Suo moto cognizance of the incident, issued notice to the Superintendent of Police, Moulobhibazar, Cabinet Secretary of the Cabinet Division, Senior Secretary of Ministry of Home Affairs and Police Commissioner, Sylhet. In response, SP Moulobhibazar sent a report to NHRC explaining that in accordance with the instruction given from Police Headquarters, Dhaka, police verification was done again and the concerned youths were at last selected for the job. Complaint No. 171/16 Ensuring Land Right Mr. X, a poor man got 01.14 and 0.13 acres of khas land given by Deputy Commissioner, Narail according to the government policy. In connivance with some influential of the locality, Mr. Y forcibly occupied the land. Mr. X repeatedly sought assistance from the administration to get his land back from Mr. Y. But no one helped him. Finally, Mr. X lodged complaint at NHRC. were landless, DC, Narial allotted them the khas land. Surveyor of land on the basis of the application marked the boundary of the land on 12/03/2016. But later they could not go for possession. It was found that someone lifted the wall of boundary. The defendant failed to show any documents in support of the ownership of impugned property except a receipt of suit of the land. After reviewing the report, it was found that the defendant has no document except the receipt of the suit of the land and there was no clear statement of injunction over the land. When UNO, Kalia, Narail was asked to take legal measures for giving the possession of allocated khas land in favor of the complainants, he assigned AC(Land), of Kalia, Narial to investigate and a report was submitted which stated that, the allotted land for the landless was given possession with measurement by red flag. Later, when the landless were asked about their getting possession in the presence of the audience, they replied in affirmative and said they’ve got their possession. NHRC took the case with strong conviction and asked UNO, Kalia, Narail, to submit a report on the complaints on an urgent basis after investigation.
