Chapter 2 - Report of the Complaints, Monitoring and Inquiries Group Upon scrutiny, the Commission forwarded the relevant complaints to the police for their feedback and action. Since 2013, the Commission and the police have established a working relationship where all complaints in relation to the police will be channelled to the Secretary of PDRM in Bukit Aman. The Secretary is responsible for obtaining feedback from the force and reverting to the Commission. (b) University Students’ Call to Abolish UUCA The Commission received complaints from various student groups alleging that the disciplinary actions taken by the administration of their respective universities violated their fundamental rights, which were guaranteed under the Federal Constitution. A group from the University of Malaya (UM) expressed dissatisfaction when their fellow students were served with show cause letters for participating in a protest in front of Parliament on 8 April and in another during the visit of US President Barack Obama to UM. Students from the University of Malaysia Sabah (UMS), Labuan International Campus claimed that 16 students were subjected to disciplinary proceedings and several actions were taken including warning and suspension from residential colleges for their alleged participation in an assembly within the university compound without permission. Students from the Sabah branch of UiTM informed the Commission that one of the students was subjected to disciplinary action for allegedly making a statement supporting 16 UMS students on social media. He was allegedly asked to answer 11 charges levied against him by the disciplinary board. (c) Murum Dam On 18 June, the Commission visited the resettlement areas of the indigenous peoples. The Commission went to the primary school - SK Tegulang, and the resettlement area - Long Malim (Kenyah) and Long Wat (Penan). Besides that, the Commission also visited the construction site of the Murum Hydroelectric Dam. The visit was facilitated by Sarawak Energy Bhd (SEB). Prior to the visit, the Commission was briefed by SEB on their various efforts in assisting the relocation and resettlement of the indigenous communities. Please refer to page 108 on the issues discussed with SEB and the Commission’s findings on the conditions at the primary school and the resettlement areas. (d) Rights of Workers The Malaysian Trade Union Congress (MTUC) lodged a complaint to the Commission in October claiming that union busting activities by employers continued to take place. According to MTUC, the employers have been taking disciplinary actions, suspending and terminating the office bearers and members of the unions. 47
