Hak Politik Penyandang Disabilitas dan Ruang Lingkupnya mengikutsertakan sistem Pemilu yang adil dan aksesibel. Ini sesuai dengan perjanjian International Covenant on Civil and Political Rights yang diperkuat oleh resolusi PBB tentang HAM menetapkan bahwa setiap warga PD mempunyai hak khusus berupa kemudahan dalam memperoleh pelayanan dan atau penyediaan sarana termasuk jaminan kerahasiaan pilihan dalam penyelenggaraan Pemilu. Semua hak tersebut harus dilaksanakan oleh penyelenggara Pemilu tanpa diskriminasi, pembatasan, pengurangan, penghambatan yang disebabkan oleh disabilitas fisik, intelegensi, kebuta-hurufan, dan rendahnya pendidikan. Negara berkewajiban untuk menyusun kerangka hukum yang menunjukkan keberpihakan (Affirmative Action) untuk mengatasi hal-hal tersebut, sehingga warga negara PD dapat melaksanakan hak politiknya secara penuh dengan asas kesamaan, keadilan dan bermartabat. Dalam rangka menegakkan hak politik yang universal bagi PD, International Foundation for Election System (IFES) dan International Institute for Democracy and Electoral Assistance (IDEA) menggelar workshop di Sigtuna Stockholm Disabilities Swedia pada 14-17 September 2002. Hadir dalam workshop tersebut antara lain petugas pelapor PBB bidang PD, wakil-wakil parlemen, wakil-wakil Komisi Pelaksana Pemilu dan wakil-wakil organisasi PD dari 45 negara, termasuk Indonesia. Workshop tersebut telah menghasilkan sebuah dokumen internasional penting berupa The Bill of Electoral Right for Citizen with Disabilities (piagam tentang hak bagi pemilih PD). Butir-butir The Bill of Electoral Right for Citizen With Disabilities sebagaimana dikemukakan di atas, akhirnya terlegitimasi secara formal dalam instrumen hukum internasional yaitu International Convention on the Rights of Person With Disabilty, Resolusi PBB 61/ 106 13 Desember 2006 khususnya pada article 29 yang selengkapnya berbunyi: “States parties shall quarantee to person with disabilities political rights and the opportunity to enjoy them others, and shall undertake: a. To ensure that persons with disabilities can effectively and fully participate in political and Public life on an equal basis with others, directly or through freely chosen refresentatifs, including the right and opportunity for persons with disabilities to vote and elected, inter, via, by: 1. Ensuring that voting procedures, facilities, and materials, are appropriate, accesible and easy to understand and use; 2. Protecting the right of persons with disabilities to vote by secret ballot in election and Publik referendums without intimidation, and to stand for elections, to effectively hold office and perform all 0020 Publik functions all levels of government, facilitating the use of assistive and new technologies where appropriate; 3. Guaranteeing the free expression of the will of persons with disabilities as electors and to this end, where necessary, at their reguest, allowing assistance in voting by person of their own choice. 111
