THE RECOGNITION OF THE KOMNAS HAM RI INITIATIVE IN BUSINESS AND HUMAN RIGHTS REGULATIONS Presidential Regulation Number 60 of 2023 concerning the National Strategy for Business and Human Rights places the working paper prepared by the Commission together with ELSAM as part of the process of normalizing the business and human rights ecosystem in Indonesia: The process of developing the National Action Plan on Business and Human Rights was then followed up by Komnas HAM RI supported by a non-governmental organization, namely ELSAM (Institute for Community Studies and Advocacy) through a study with the results in the form of a policy paper entitled: The Urgency of Preparing and Developing a National Action Plan for Business and Human Rights in Indonesia. This policy paper is the background for the creation of this BHAM National Strategy. The application of a business and human rights perspective is used by the Commission in handling business activities that have an impact on human rights and the environment. Through- out 2023, the activities of the Commission which intersect with strategic business and human rights issues can be seen in the table below: Table 2.6. The Response of the Commission in Handling Strategic Business and Human Rights Issues BUSINESS AND HUMAN RIGHTS CASES 34 RESPONSE OF KOMNAS HAM RI Rempang Eco City Project, in Batam The Commission identified six rights that were violated, including: (1) the right to feel safe and free from intimidation; (2) the right to obtain justice; (3) the right to adequate housing; (4) the right to welfare; (5) children’s rights; and (6) the right to participation and information, in particular the application of free, prior and informed consent. Komnas HAM RI accepts complaints, mediation, field monitoring, and requests for information from related parties. Komnas HAM RI also asked the Indonesian Police to follow up on the handling of the situation that occurred on Rempang Island and carry out an internal evaluation to continue to improve procedures for handling disputes in the community. P.T. Gunbuster Nickel Industry (GNI) North Morowali Regency, Central Sulawesi The Commission identified negligence and lack of maximum effort in implementing Occupational Safety and Health (K3), thereby increasing the risk of work accidents. Fire at PT. Depot Pertamina Plumpang, Jakarta The Commission recommends PT Pertamina to build an Early Warning System and provide emergency handling training for local communities.
