d Custodial death of Shrl Bgndoo in Uttsr Pmdbrh The Senior Superintendent of Police, Moradabad vide his fax message dated 14 October, 1985 reported ths death of one Bundoo while In custody. The Commission took cognizance and called for a report frwn the Gwernmsnt of Uttar Pradesh. In their report, the Government strbsd that an 12 October, 1995 a case under section 3021301 IPC in crime No. 273195 wps registsrsd at Police Station Chondpur, Bijnom District against four named person#. The msa came to be investigated by an SHO. Two of the accused persons were arrested in the morning of 13 October and on intermgation one of them described the placa of incident. Aftsr being handcuffed, he was taken to the site for identification in mune of invsrtigation. He had also indicated that he would lead the police to the discwery of weapons u 6 d for the offence. Two police SHOs along with a host of constables proceeded to the place. Suddenly, Bundoo jumped out of the vehicle and came to fall in front of a moving bus. He received serious injuries which ultlmrtely led to his death at Moradabad District Hospital. The SSP indicated that the two Inspectors concerned had been ordered to be present at the roll call and orders for departmental action would soon be initiated. The long report8 and the connected material were scrutinised by the Commission. Accepting the same to bs true version of the incidant, the Commission hew that the deceased sustained grievous i n j h when he jumped from a moving jeep and fall before a speeding bus. There was no dispute that a hout of constables were also travelling in the jeep along with the deceased who had already been handcuffsd. It war the obligation of tha constables to emure that the handcuffed eccused would not run away from the jeep. The fact that a#r many police officers were present in the jeep when the deceased jumped out of the vohide showed grosa negligencs by the police guard. The Cornmimion rscammsnded that an enquiry be undertaken immediately and the concerned police offiean and the constables, if found guilty of negligence, ba adequately punishud. The Commission took the view that cornpandon shwld be paid to the next 2f the kin of the deceased and recommsnded a coinpensation of Rs. One lakh in this _respect.
