CHR-NCR: VIOLATION OF MCW – THE
‘RAPE JOKE’ OF DURTERTE
The complaint was received by Chairperson
Gascon and was docketed as CHR-NCR 2016078. The complaint primarily alleged that then
presidential candidate Duterte violated the MCW
as shown in a “string of actuations showed in print
and in video,” showing Duterte’s alleged “callous,
derogatory, and insulting treatment of women.” The
complaint also enumerated the instances wherein
Duterte “flaunted his disregard for women.” The
complaint further alleged that the act of Duterte in
“making the rape of a woman who was later killed a
laughing matter, and to treat women as playthings
to be taken advantaged of constitute an affront to us
and all women.” The complaint added that instead
of being an exemplar of a respectable, law-abiding
citizen, Duterte “arrogantly flaunts his power over
these women and diminishes their worth as human
beings.”
The Commission ruled in favour of
complainants holding that acts cited violates the
MCW which prohibits all forms of discrimination
and violence against women. The CHR
recommended the filing of appropriate charges, and
the incorporation of women’s human rights and GST
in the curricula of all educational institutions.

Chairperson, the complainant, a person with mental
disability assisted by her mother, complained of
discrimination against the show for using facilities
that were not PWD-friendly such as comfort rooms
and not permitting them to enter the Wowowin
studio. On behalf of the complainant, the Regional
Office informed the show of the complaint and
secured their response. A compromise agreement
was reached through mediation. The Wowowin
lawyers promised the complianant of another chance
to watch the show.
While the case was mediated, the
Commission recommends that accessibility be
accorded by establishments for PWDs in accordance
with law.
CHR-NCR: DISCRIMINATORY ATTITUDE
BY AN RTC JUDGE
A complainant filed a case against an RTC
judge for violation of RA 9262. She complained
that during the course of the hearing, the judge
commented several times that the VAWC case is a
matter among married couples and should be settled
amicably. The judge further added that the case was
just money matter and that the husband just pay her.
For the complainant, the statement of the judge was
insensitive. It is also a violation of R.A. 9262, and
the MCW which prohibits the discrimination against
women. While the Supreme Court has the sole
discretion to discipline judges, the CHR sent a letter
to the judge informing him of the complaint. There
was no response from the judge. The same letter was
later resent copy furnished the Supreme Court.
