Persons from Enforced Disappearances or involuntary disappearances amounting to criminal offences or breaches of civil liability/human rights under Malaysia law; b) If (a) has been established at the inquiry: i. How such criminal offences or breaches of civil liability/ human rights came about; ii. Which person(s) or agency(ies) was/were responsible for such criminal offences or breaches of civil liability/human rights; and iii. What administrative directives or procedures, or arrangements contributed to such criminal offences or breaches of civil liability/ human rights. c) To consider whether the authorities, specifically the Royal Malaysia Police have taken adequate steps to investigate these cases. d) To recommend measures or guidelines to be taken to ensure that such breaches of civil liability/human rights do not recur. At the time of writing, 11 witnesses including police officers had testified before the Panel of Inquiry in the Raymond Koh case during the 11 days of Public Inquiry. The Public Inquiry will resume its session next year. (ii) Rights of the child Malaysia is a State Party of the Convention on the Rights of the Child (CRC), and the convention obligates the State Parties to ensure the child such protection and care as is necessary for his or her well-being. During the year, there were several tragedies involving children at religious/Tahfiz schools which saddened the Malaysians. In April, an 11-year-old boy, Mohamad Thaqif Amin Mohd Gadaffi, passed away at Hospital Sultan Ismail, Johor Bharu after he was admitted for several days and had his legs amputated. Prior to his death, the boy who was a former student of a Tahfiz school in Kota Tinggi was reportedly assaulted with a rubber hose by the school dormitory assistant warden. The Commission visited the Tahfiz school on 3 May as part of the Commission’s initiative to investigate the case from the human rights perspective. During the visit, the Commission viewed the CCTV recording of the alleged assault and had a dialogue with the school management.
