I. Introduction 1. This submission is made by the National Human Rights Commission of Korea (hereinafter referred to as “the Commission”) in regards to the selection of list of issues prior to the UN Committee on the Rights of Persons with Disabilities’ (CRPD) review of the second and the third national reports of the Republic of Korea on the implementation of the Convention on the Rights of Persons with Disabilities (hereinafter referred to as “the Convention”). 2. The Commission is an independent national human rights institution, the antidiscrimination deliberation institution in accordance with the Anti-Discrimination against and Remedies for Persons with Disabilities Act (ARPDA), and a monitoring institution for the implementation of the Convention. The Commission is pleased to provide information to the CRPD that is relevant to the Republic of Korea’s implementation of the Convention as a measure of the Commission’s support to the Committee’s selection of issues. 3. The submission of the Commission draws upon materials and records submitted by respective government agencies in relations to the recommendations made by the CRPD in its concluding observations on the initial report of the Republic of Korea, and the policy recommendations, expressions of concern and recommendations of correction issued by the Commission. II. General Principles and Obligations (Article 1-4) Current status 4. The current stand of the Korean government is that the rights underlined in the Convention is sufficiently protected through the anti-discrimination deliberation institution (NHRCK), in accordance with the ARPDA, and civil and criminal courts. The government also states that the ratification of the Optional Protocol to the Convention will be followed after sufficient level of monitoring has been facilitated by the anti-discrimination deliberation institution and through courts’ remedial procedures. On the related note, the Republic of Korea has ratified the Optional Protocol to the International Covenant on Civil and Political Rights and the Optional Protocol to the Convention on Elimination of All Forms of Discrimination against Women, which were brought into effect on 10 July 1999 and 22 December 2000, respectively. 3
