ความสัมพันธ์ระหว่างสิทธิมนุษยชนและสิ่งแวดล้อม เพื่อการคุ้มครองสิทธิมนุษยชนที่เกี่ยวกับสิ่งแวดล้อมอย่างยั่งยืน Article 1042 หรือ สิทธิในกระบวนการยุติธรรม (Right to a Fair Trial) ภายใต้ Article 643 เป็นต้น ทั้งนี้ ศาลสิทธิมนุษย ชนแห่งยุโรปได้มีการน�ำเอาสิทธิเชิงกระบวนการดังกล่าวมาใช้ในบริบทที่เกี่ยวกับสิ่งแวดล้อม เช่น ศาลสิทธิมนุษยชนแห่ง ยุโรปในคดี Bladet Tromso v. Norway44 ได้ตัดสินว่าประเทศนอร์เวย์ละเมิดสิทธิในการเข้าถึงข้อมูลข่าวสารตาม Article 10 เนื่องจากค�ำตัดสินของประเทศนอร์เวย์ซึ่งตัดสินให้หนังสือพิมพ์ที่รายงานข่าวการล่าแมวน�้ำมีความผิดฐานหมิ่น ประมาท เป็นกรณีที่ประเทศนอร์เวย์ใช้กฎหมายมาเป็นเครื่องมือในการแทรกแซงสิทธิในการเข้าถึงข้อมูลข่าวสารของ ประชาชน นอกจากนี้ ในคดี Zander v. Sweden45 ซึ่งเป็นคดีที่ผู้ร้องกล่าวอ้างว่าไม่ได้รับการ เยียวยาความเสียหายจากภัยอันอาจเกิดขึ้นจากการปนเปื้อนของแหล่งน�้ำชุมชน ศาลสิทธิมนุษยชนแห่งยุโรปได้ตัดสินว่า มีการละเมิดสิทธิในกระบวนการยุติธรรมของประชาชนในการที่จะได้รับการชดใช้เยียวยาตาม Article 6 เห็นได้ว่าภูมิภาคยุโรปให้การสนับสนุนสิทธิเชิงกระบวนการเกี่ยวกับสิ่งแวดล้อม และได้ น�ำเอากลไกทางสิทธิมนุษยชนมาใช้ในบริบททางสิ่งแวดล้อมโดยอาศัยสิทธิเชิงกระบวนการ และแม้สิทธิในกระบวนการ เหล่านี้จะไม่ได้มีการบัญญัติคุ้มครองสิ่งแวดล้อมไว้โดยตรง แต่ก็เป็นเครื่องมือส่งเสริมการมีส่วนร่วมของประชาชน ให้ ประชาชนสามารถเข้าถึงข้อมูลข่าวสารเกี่ยวกับสิ่งแวดล้อมได้ ทั้งยังคุ้มครองประชาชนจากอันตรายที่อาจเกิดจากความ เสื่อมโทรมทางสิ่งแวดล้อมได้ในระดับหนึ่ง 43 Article 6 of the European Convention on Human Rights states that “Right to a fair trial states that 1. In the determination of his civil rights and obligations or of any criminal charge against him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. Judgment shall be pronounced publicly but the press and public may be excluded from all or part of the trial in the interests of morals, public order or national security in a democratic society, where the interests of juveniles or the protection of the private life of the parties so require, or to the extent strictly necessary in the opinion of the court in special circumstances where publicity would prejudice the interests of justice 2. Everyone charged with a criminal offence shall be presumed innocent until proved guilty according to law. 3. Everyone charged with a criminal offence has the following minimum rights: (a) to be informed promptly, in a language which he understands and in detail, of the nature and cause of the accusation against him; (b) to have adequate time and facilities for the preparation of his defence; (c) to defend himself in person or through legal assistance of his own choosing or, if he has not sufficient means to pay for legal assistance, to be given it free when the interests of justice so require; (d) to examine or have examined witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him; (e) to have the free assistance of an interpreter if he cannot understand or speak the language used in court.” 44 From Bladet Tromso v.
