The police personnel also appeared to be acting in groups. The Panel questions the necessity for such assaults and abuse when there was no evidence of any resistance or violence on the part of those arrested. In the absence of any evidence to the contrary, and while the Panel is aware of the power of the police to use all reasonable force in order to effect arrest and disperse the participants in a public assembly, the Panel finds that disproportionate force was used to effect the arrest of those witnesses, as well as after their arrests, resulting in injuries to them. These findings were confirmed by the testimonies of W5, W21 and W30 as well as videos from both PDRM and the witnesses.
