NHRC
NHRC can assist poor victims by providing them with free legal aid through
appointing panel lawyers as per article 12 (DA) of NHRC Act 2009. Article 3 (2)
mentions that Commission can lodge case in it’s name or anyone can also lodge
case against it. Article 19 (6) says that Commission can compete in any human
rights violation case being a party. Present Commission has decided to continue
providing free legal assistance to the victims. Mention may be made to the case of
Mustakim, who was arrested for protesting in Chittagong on the issue of increased
dialysis fee. NHRC Chairman immediately instructed to arrange for Mustakim’s
bail and Mustakim was given bail accordingly with assistance from NHRC and
NHRC was mentioned as number two opponent party in this case. NHRC has
decided to respond to the case through appointing it’s panel lawyer.
Since the beginning of the new Commission on 10.12.2022 panel lawyer has
been appointed in 6 cases. Besides, many cases have been referred to
District Legal Aid committee.
On the other hand, cases can be lodged against the Commission. An NGO named
“Manobadhikar Protishtha o Bastobayan Sangstha” was involved in fraudulent
activities and took money from people by cheating with them. NHRC received
complaint on this and sent letter to Deputy Commissioner of Khulna to submit report.
The Deputy Commissioner informed that the complaint found to be true. NHRC
formed 03 member bench and the bench recommended to ban that organisation’s
registration on 19.09.2021. As per this recommendation, the Joint Stock Company
nullified its registration on 16.01.2022. The organisation filed writ petition
against this action.
