REGULATION ON THE ELECTION OF COMMISSIONER OF THE NATIONAL HUMAN RIGHTS COMMISSION
AND NATIONAL PREVENTIVE MEC HANISM AGAINST TORTURE
GENERAL PROVISIONS
1.1. The purpose of this regulation is to regulate the nomination of an individual that meets the
requirements to the State Great Khural of Mongolia for the selection and appointment of Commissioners
of the National Human Rights Commission and the Commissioner in charge of National Preventive
Mechanism against Torture (hereinafter referred to as “Commissioner”) in accordance with Article 12.12
and Article 32.7 of the Law on the National Human Rights Commission of Mongolia /revised version/.
1.2. The selection of the Commissioner shall be announced based on the number of vacancies and
nominated in accordance with this regulation.
1.3 The following principles shall be adhered during the selection process of Commissioners:
1.3.1. Rule of law;
1.3.2. Fairness and Justice;
1.3.3. Independence;
1.3.4. Neutrality;
1.3.5. Practicality;
1.3.6. Transparency;
1.3.7. Impartiality.
1.4. The terms used in this regulation shall have the following meanings:
1.4.1."commissioner" means a Commissioner of the National Human Rights Commission and
Commissioner in charge of National Preventive Mechanism against Torture;
1.4.2. "Commission" means the National Human Rights Commission;
1.4.3. "Applicant" means an individual who has submitted an application for the nomination of
Commissioner of the National Human Rights Commission or in charge of the National Preventive
Mechanism against Torture;
1.4.4."participants" means an individual registered as a participant in the nomination process in
accordance with Article 7.1 of this Regulation;
1.4.5. “candidate” means a participant nominated to the Standing Committee on Legal Affairs by the
Working Group in accordance with Article 10.4 of this Regulation.
1.5. The selection of Commissioners shall be carried out by the Working Group. The working group will
have the following functions:
1.5.1. to receive and review candidacy applications and relevant documents;
1.5.2. to decide whether to register the applicant as a participant in the nomination process;
