10 juveniles granted bail but have no recourse to sureties

6 juveniles (one aged 11 years) accused of small thefts of khachra iron and mobile
phones under Sec 457 PPC are incarcerated as well.
Under JJSA 2018, they should have been released under Sec 6 (3) which states;
“Where a juvenile is arrested or detained for commission of a minor or a major
offence for the purposes of this Act, he shall be treated as if he was accused of
commission of a bailable offence”.
Through pro bono lawyer Mr Haseeb Sultan and Mr Waqar Ahmad, NCHR has
moved to apply for bail for 11 juvenile prisoners and secured bail for 9
prisoners (table below on page 22) and seek donor support for provision of
surety.

No criminalization of torture under domestic law.
Five separate bills on Torture have been presented in parliament to no avail.
Over past 5 years in DIG region, only one official has been dismissed from service
for violating human rights - he is simply a dispenser at the jail (Annex D)
4309 inmates or 70.6% of prisoners are under trial.
There are 900 prisoners from KP, away from their families. Haripur Jail has a
capacity of 800 prisoners but only 300 inmates - it is operating under-capacity but
still, prisoners from KP are not being transferred there

35 inmates recorded their statements, 26 prisoners (74%) have alleged torture and
inhuman and degrading treatment of different types. (Synopsis of statements of
victims - names withheld - of alleged torture is attached as Annex E)
All the inmates (100%) have spoken about financial extortion for each and every
genuine facility available at the jail
Current Oversight Committee, headed by Director Agriculture Institute and a retired
prison officer, notified on 18.03.2022, has not visited as per reports of inmates
interviewed
