RECOMMENDATIONS Also identified in Chapter 9 are a series of recommendations for legal, policy and institutional reform measures that should be adopted to ensure that the Philippines complies with its obligations under international human rights law. Part A of the recommends the adoption of the following legislative reforms to protect human rights during the eviction and resettlement process: Recommendation A1: The law should establish anti-discrimination provisions to protect marginalised and vulnerable groups from the effects of forced evictions and resettlement Recommendation A2: The law should ensure that no individual or family is subject to summary eviction or permanently unable to access housing subsidies Recommendation A3: The law should expressly provide for a mandatory and detailed process of consultation prior to evictions Recommendation A4: The law should prescribe specific requirements for the content of eviction notices and the manner in which they are dispensed Recommendation A5: The law should provide for the prioritisation of restitution and on-site resettlement Recommendation A6: The law should establish a universal and comprehensive eviction compensation framework Recommendation A7: The law should provide detailed and mandatory requirements for conditions in resettlement sites Recommendation A8: The law should be updated to prohibit evictions under specific conditions Part B of the recommendations identify the following institutional reform measures to protect human rights in the housing and urban development sector: Recommendation B1: The Government should vest an independent, national body with the exclusive power to monitor and hear appeals relating to eviction and resettlement Recommendation B2: The Government should take steps to institutionalise community and civil society participation in the housing sector Recommendation B3: The Government should consider the consolidation of key housing and shelter agencies Recommendation B4: All housing-related obligations under the law should be streamlined to ensure the accountability of government Recommendation B5: A single government entity should be identified as responsible for the conduct of evictions xii
