The need for a human rights-based approach to the response and mitigation of COVID-19
and the achievement of the SDGs, is becoming more evident.The developments over the
past year have shown that without respect for and enforcement of human rights values,
norms and principles, the citizens’ livelihoods and realization of fundamental rights are
deteriorating due to COVID-19, and the SDGs targets are becoming more difficult to achieve.
3.2. Recommendations
Based on these conclusions, this preliminary study recommends several things to the
government and Komnas HAM RI as well.
1. Recommendations to the government:
a. The government is encouraged to design better social protection governance
based on two considerations. First, the implementation of social assistance still
has many problems, as stated in this study. Second, the large amount of allocated
budget makes it vulnerable to criminal acts of corruption. Reform of the social
protection program needs to be carried out immediately, based on the life cycle,
and comply with human rights norms, principles and standards, as stipulated in the
1945 Constitution of the Republic of Indonesia, the Human Rights Law, and various
fundamental human rights instruments internationally.
b. The government is encouraged to build better and more sustainable health
governance. It includes ensuring the availability and distribution of medical and
healthcare personnel, medical equipment, vaccines, as well as guaranteeing the
protection of health workers' right to life. Good policies and programs to address
the availability and inequality of medical and healthcare personnel are needed to
ensure the fulfillment of citizens' right to health, as well as ensuring that health
workers’ safety and right to life are guaranteed.
c. In the mitigation of COVID-19, the government needs to create framework that
aligns with human rights principles, and integrate them in the SDG planning and
programming. Besides providing working principles/paradigms, the instruments
give the more technical but comprehensive working methods, such as evaluation
tools and indicators, and ensures that no one is left behind. In their arrangement
and implementation, it is essential to involve related institutions such as Komnas
HAM RI.
2. Recommendations to Komnas HAM RI:
a. Komnas HAM RI needs to maintain consistency in its role in monitoring the mitigation
of the COVID-19 pandemic, either from the health, or social and economic aspects,
so it will not leave anyone behind, which is in line with human rights standards.
b. Komnas HAM RI needs to continue to develop more comprehensive initiatives
integrating SDGs and human rights, and use it to ensure that governance for the
mitigation of the COVID-19 pandemic is in line with the SDGs and human rights
agenda.
