Chapter 2 Investigations and Remedies: Human Rights Violations and Discriminatory Acts Section 1. Overview Pursuant to Article 19 Subparagraph 2 and 3 of the National Human Rights Commission Act, the NHRCK has made investigations into and provided remedies for human rights violations and discriminatory practices. The scope of its investigations include violations of and/or discriminatory acts against human rights that have been stipulated in Article 10 to 22 of the Constitution of the Republic of Korea, and discriminatory acts committed by legal entities, organizations or individuals, in relation to the work of governmental organizations; local government groups; schools that are installed in accordance with Article 2 of the Elementary and Secondary Education Act and Article 2 of the Higher Education Act; public service-related organizations or correctional/institutional group care facilities (excluding legislation of the National Assembly, and the trials of the Courts and the Constitutional Court) that are stipulated in Article 3-2 Clause 1 of the Public Service Ethics Act. Private schools and public service-related organizations have been included in the scope of its investigations since the revision of the National Human Rights Commission Act that was enacted on March 21, 2012. In general, investigations into the aforementioned human rights violations and discriminatory acts begin with the victim filing a complaint. Complaints can be filed by the victims themselves or by a third party, individual or organization provided they are aware of the case.
