Section 24DC
(g) any matter concerning rights conferred by Subdivision Q
(which gives certain persons covered by registered native
title claims rights of access to non-exclusive agricultural and
pastoral leases).
Note 1:
If the agreement involves consent to the doing of a future act or class
of future act, or the doing of a future act or class of future act subject
to conditions, it must include a statement to that effect: see
paragraph 24EB(1)(b).
Note 2:
If a future act covered by such a statement would otherwise be subject
to the “right to negotiate” provisions in Subdivision P, the agreement
must also include a statement that those provisions are not intended to
apply: see paragraph 24EB(1)(c).
24DC No extinguishment of native title
The agreement must not provide for the extinguishment of any
native title rights or interests.
Note:
The non-extinguishment principle will apply to any future acts
consented to in the agreement: see subsection 24EB(3).
24DD Bodies corporate and representative bodies etc.
No bodies corporate for whole of area
(1) The agreement must not be made if there are registered native title
bodies corporate in relation to all of the land and waters in the area.
Note:
If there are registered native title bodies corporate for all of the area,
an agreement under Subdivision B may be made.
Body corporate or representative body for area
(2) There must be at least one registered native title body corporate in
relation to land or waters in the area or at least one representative
Aboriginal/Torres Strait Islander body for the area.
