D. Opinion on the Partial Amendment Bill on the Enforcement
Decree of the Act on Equal Employment and Support for Work-Family
Reconciliation
Regarding the partial amendment bill on the Enforcement Decree of the Act on
Equal Employment and Support for Work-Family Reconciliation, on September 12,
2014, the Commission expressed its opinion that the mandatory education to prevent
sexual harassment should be maintained at the current status, on the grounds that
the employer's responsibility to conduct education to prevent sexual harassment
at work, as stipulated by the Act does not cause an extreme economic burden to
small businesses and a number of alternatives rather than the expansion of
exceptional cases can be sought for. Moreover, it recommended to identify measures,
in the long term, to conduct effective education to prevent sexual harassment in
work environments with less than 10 employees which are classified as an exempt
under the current Act.
E. Opinion on the Bill of Preventive Custody Act
On September 3, 2014, the Ministry of Justice initiated the pre-announcement of
the Preventive Custody Act intending to put highly dangerous criminals such as sexual
offenders, murderers, or child sex offenders in custody for a certain period of time
after they serve out the term of their sentence.
Regarding this legislation pre-announcement, the Commission, on December 8,
2014, expressed its opinion to the Minister of Justice that the enactment of the
Preventive Custody Act is not desirable as it may undermine human worth and dignity
(Article 10) and personal liberty (Article 12) guaranteed by the Constitution, given
that the adequate grounds for the proportionality of the means and the principle
