have stayed in this country for longer than 90 days (from the date of their entry), are registered at the Immigration Office and fall into the schooling age (7~18) as of 2010. The data released by the Ministry of Education, Science and Technology shows that, as of 2010, approximately 11,700 immigrant children are enrolled in schools, including 1,748 children of migrant workers. Based on these sets of data, we can guess that about 8,000 immigrant children do not attend school. Meanwhile, there are no official statistical data on the number of unregistered immigrant children, but "The 2008 Survey on the Rights of Unregistered Immigrant Children" by the Ministry of Health and Welfare estimated the number at 8,259 (which compares to an estimate of 20,000 by the civic groups). All considered, it can be said that at least 15,000 immigrant children at their schooling age do not attend school. 25. "The 2010 Survey on the Rights of Education of Immigrant Children" by NHRCK reveals that the immigrant children at school experienced disregard and discrimination from Korean students on the ground of their foreign language accent, skin color and mother country and suffered threats or assaults or had their belongings taken away. These experiences prevented the immigrant children from adapting themselves to a school life in this country. 2) Questions 26. Please give the data which shows the situation on the school enrollment of immigrant children at their schooling age (7 or older and under 18). What measures does the Government undertake or intend to undertake to guarantee the right to minimum education of immigrant children and eliminate discrimination against them? 2. Respect for the views of the child 1) Current situation 27. The law on children provides for the respect for the children's views. However, there are no institutional guarantees for the children's right to participate in the matters that affect them at school, etc. For instance, the School Steering Committee, whose establishment is provided for in Article 31 of the Elementary and Secondary Education Act, is supposed to consist of the representatives from teachers, parents and community leaders, excluding the students of the school. In addition, although the Government recommends that children's views should be reflected in the process of devising or revising school regulations, the reality is that, at least in some schools, the process is mainly led by the headmaster or teachers and the students' participation in the process is no more than a formality. - 7 -
