การยุยง หรือโดยความยินยอม หรือรู๎เห็นเป็นใจของเจ๎าพนักงานของรัฐ หรือของบุคคลอื่นซึ่งปฏิบัติหน๎าที่
ในตาแหนํงทางการทั้งนี้ไมํรวมถึงความเจ็บปวดหรือความทุกข์ทรมานที่เกิดจาก หรือเป็นผลมาจาก หรือสืบ
เนื่องมาจากการลงโทษทั้งปวงที่ชอบด๎วยกฎหมาย
Article 1
1. For the purposes of this Convention, the term "torture" means any act by which
severe pain or suffering, whether physical or mental, is intentionally inflicted on a person
for such purposes as obtaining from him or a third person information or a confession,
punishing him for an act he or a third person has committed or is suspected of having
committed, or intimidating or coercing him or a third person, or for any reason based on
discrimination of any kind, when such pain or suffering is inflicted by or at the instigation
of or with the consent or acquiescence of a public official or other person acting in an
official capacity. It does not include pain or suffering arising only from, inherent in or
incidental to lawful sanctions.

Disabilities - CRPD)
อนุสัญญาฉบับนี้เน๎นไปที่การขจัดอุปสรรคในการดาเนินชีวิตของผู๎พิการ ตลอดจนการแก๎ไขความ
เสียเปรียบทางสังคมของคนพิการ ซึ่งกํอให๎เกิดการเลือกปฏิบัติ และขัดขวางการสํงเสริมและพัฒนาคุณภาพ
ชีวิตคนพิการ
สาหรับหลักการเกี่ยวกับความเท่าเทียมกันและการห้ามเลือกปฏิบัติปรากฏโดยเฉพาะดังนี้
ข้อที่ 2 (นิยาม)
“การเลือกปฏิบัติเพราะเหตุแหํงความพิการ” หมายถึง ความแตกตําง การกีดกัน หรือการจากัด
บนพื้นฐานความพิการซึ่งมีความมุํงประสงค์ หรือสํงผลให๎เป็นการเสื่อมเสียหรือทาให๎ไร๎ผลซึ่งการยอมรับ
การอุปโภคหรือการใช๎สิทธิมนุษยชนและเสรีภาพขั้นพื้นฐานทั้งปวง บนพื้นฐานที่เทําเทียมกับบุคคลอื่น ใน
ด๎านการเมือง เศรษฐกิจ สังคม วัฒนธรรม ความเป็นพลเมืองหรือด๎านอื่นๆ รวมถึงการเลือกปฏิบัติในทุก
รูปแบบ รวมทัง้ การปฏิเสธการชํวยเหลือที่สมเหตุสมผล
Article 2 (Definition)
“Discrimination on the basis of disability” means any distinction, exclusion or
restriction on the basis of disability which has the purpose or effect of impairing or
nullifying the recognition, enjoyment or exercise, on an equal basis with others, of all
human rights and fundamental freedoms in the political, economic, social, cultural, civil
