overseas should be progressively increased based on the adjustment
mechanism for minimum wage. Wages should in principle be paid
directly and in full. In terms of working hours, employers should receive
mentoring on using technology-based management of attendance records
to ensure that fishermen receive sufficient rest. Further improvements
are also recommended in the following areas where there are significant
discrepancies in existing legislation:
❶ Social insurance protection: Fishermen hired domestically are entitled
to labor insurance, occupational accident insurance, and National
Health Insurance. Occupational accident insurance is in effect a form of
liability insurance for employers as well. Fishermen hired overseas are
only entitled to commercial insurance of no less than NT$1 million. This
offers inadequate protection to fishermen, and the employer is still liable
for compensation claims from the fishermen if there is an accident.
❷ O ccupational accident protection and compensation: Owners
of fishing vessels that measure over 24m in length or routinely
spend more than 3 days at sea are expected under the convention to
establish prevention plans for occupational accidents,
occupational injuries, and occupational diseases 17.
Fishermen should be able to obtain appropriate medical
treatment and compensation in line with national
legislation18.
