The Court further held that: The internationalcommtions and norms are to be read into them in the absence of enacted domestic law occupying the field when there is no inconsistency between them. It Is now an accepted rule of judicial construction that regard must be had to international conventions and norms for constructing domestic law when there Is no inconsistency between them and there is a void in the domestic laws," 4.10 Further, in the case Apparel Export Promotion Council vs. A.K.Chopra (1999(1)SCC 759), the Supreme Court held: The Courts are under an Migation to give due regard to internationalconventions and norms for conabuing domestic laws, more so, when there is no inconsistency between them and there is a void in domestic law;" and '.....In cases involving violation of human rights, the country must forever remain alive to the international instruments and conventions and apply the same to a given case when there is no inconsistency between the international norms and the domestic law'occupylng the field." In the light of the above, the Commission intends, in the period ahead, to focus in greater detail on the effective implementation of treaties and International instruments on human rights. Further, as indicated earlier, research in this respect will be undertaken for the Commission by the,newly established National Institute for Human Rights in the National Law School of India University in Bangalore. 4.1 1 The Commission has observed that the United Nations Treaty Bodies are themselves keen on the fuller association of National lnstitutions for the Promotion and Protection of Human Rights with their work. Indeed, certain of them have expressed this view either in their hearings or in their written General Comments, for instance the Committee on Economic, Social and Cultural Rights, set-up under the 1966 International Covenant on that subject, has in its General Convention No.10, expressly recognizedthe potentially crucial role that National Institutions have in promoting and ensuring the indivisibility and interdependence of all human rights and has urged the fullst involvement of National Institutions in this endeavour. 4.12 4.1 3 For its part, the commission recommends, at this stage, that reports to the Treaty Bodies be submitted in a more timely manner than hitherto and that the recommendations of these Bcdies be taken fully into account in determining the policies and laws of the country.
