Annual Report 2008-2009 4.138 The NHRC took cognizance of a complaint which alleged that a pair of surgical scissors was left inside the abdomen of one Binapani Khatua of Radharampur village in Cuttack District by the doctors of SCB Medical College and Hospital in Cuttack, Orissa during an operation. When the patient complained of pain, her uterus was removed. 4.139 A report received from the Chief Medical Officer, Cuttack confirmed negligence on the part of the accused doctors. Another report received from the Secretary, Department of Health & Family Welfare, Government of Orissa revealed that departmental proceedings had been initiated against the two accused doctors. The NHRC viewed the entire incident as a serious case of professional negligence resulting in violation of human rights of the victim, who not only suffered physical pain for years, but was also deprived of her motherhood. The NHRC recommended to the State Government of Orissa to pay Rs. 5, 00,000 as monetary relief to the victim, to follow-up the departmental proceedings against the accused doctors, and also submit an action taken report. 4.140 The proof of payment of monetary relief to the victim has been received by the NHRC. However, action taken report on the departmental proceedings is still awaited from the State Government. k) Electrocution Case 32. Death of Suresh Chander Engaged by Uttarakhand Power Corporation Limited (Case No.921/35/2003-2004) 4.141 One Suresh Chander became a victim of electrocution on 28 May 2003. He had been engaged by the maintenance staff of Uttarakhand Power Corporation to work on 440 watt lt. line in an unauthorized manner. While making repairs of the transmission line he died of electrocution. 4.142 On examination of the report of the Electrical Inspector, the NHRC found that at the instance of the maintenance staff of the Corporation, Suresh Chander was found to be working in an unlawful manner at the time of the accident. The Commission held that although his name was not entered in the muster roll, he was entitled to claim compensation on the same lines as a regular worker. With these observations, the Commission recommended to Uttarakhand Power Corporation Limited to pay a sum of Rs. 2, 00,000 as monetary relief to the next of kin of the victim. Disciplinary action against the maintenance staff was also recommended by the Commission. 4.143 The compliance report, along with proof of payment, is awaited and the matter is under consideration of the Commission. l) Other Cases 33.
