Annual Report 2008-2009 from the scene, leaving the labourers at the mercy of the Bhatta owner, who in turn forces the labourers to work without payment till he recovers the entire money paid as advance to the labour contractor(s). (e) The maintenance of records in most of the Bhattas was found to be very poor. This is because the brick kiln owners and contractors concealed the payments made to the labourers to avoid any kind of inspections made by the authorities. (f) At various places, the Vigilance Committees u/s 13 of the Bonded Labour System (Abolition) Act, 1976 had not been constituted, and if constituted, hardly carried out their mandate as envisaged u/s 14 of the Act. 4.116 The above observations were placed before the Commission, whereby it directed the District Magistrates of Aligarh, Bulandshahr and Badaun districts of Uttar Pradesh for their rehabilitation. It also directed the District Magistrate of Jhajjar district of Haryana to initiate legal action against the brick kiln owners. 4.117 The response of the District Magistrates is awaited and the matter continues to be under consideration of the Commission. j) Right to Health 26. Death due to Negligence of Medical Officers in Rajasthan (Case No. 1618/20/2000-2001) 4.118 One Rakesh Sharma complained to the NHRC about the alleged negligence of Medical Officers of Mahavir Bhim Singh Government Hospital in Rajasthan which resulted in the death of four patients. 4.119 A report received from the Assistant Secretary, Government of Rajasthan revealed that one of the victims named Suresh Mathur was referred to another hospital in Jaipur on the request of his family members. There was nothing on record regarding the death of the second victim, named Om Prakash. The cause of death about the third victim named Baby Sunita was enquired into by the Lok Auykta and the matter was dropped as the allegations could not be proved. As far as the case of Abdul Majid, the fourth victim was concerned, the Government of Rajasthan decided to initiate departmental proceedings against the neuro surgeon, Dr. Krishna Hari Sharma. 4.120 The Commission recommended Rs. 1, 00,000 as monetary relief to be paid to the next of kin of the deceased, Abdul Majid. The case was closed by the NHRC on receipt of the compliance report. 27.
