NATIONAL HUMAN RIGHTS COMMISSION, INDIA 31. Gopal Lal Aheer a student of Class 12th of Govt. School, Adana, P.S. Rashmi, District Chittorgarh, Rajasthan assaulted and beaten up by his teacher (Case No. 910/20/9/2018) 32. i. The Commission received a complaint from Shri R.H. Bansal, a human rights activist, Ghaziabad, Uttar Pradesh drawing the attention of the Commission towards an incident in which Shri Kishan Lal, a teacher of a Govt. School, Adana, P.S. Rashmi, District Chittorgarh, Rajasthan assaulted and beat Gopal Lal Aheer student of Class 12th of that School. The victim was injured and admitted in a hospital for treatment. ii. Pursuant to the directions of the Commission, a report was received from the Superintendent of Police, Chittorgarh, Rajasthan stating that FIR No. 91/2018, u/s 341/323 IPC, P.S. Raashmi was registered against the accused teacher, who had assaulted the victim student. Charge sheet no. 42/2018 dated 30.06.2018 had been filed before the Hon’ble Court. Another report was received from the Under Secretary, Education Department (Group-2), Govt. of Rajasthan stating that the said PTI Kishanlal had been charge sheeted under the CCA Rules, 2017. iii. The Commission considered the report on 19.12.2018 and inter alia observed that there was admittedly a lapse on the part of the accused govt. school teacher. The said officials have been duly punished by his department. The state is vicariously liable for this act. The Commission considers this case to be a fit case for award of compensation. iv. Therefore, the Commission issued a notice u/s 18a (i) of PHR Act, 1993 to the Chief Secretary, Jaipur, Govt. of Rajasthan directing him to show cause within four weeks as to why the Commission should not recommend payment of compensation of Rs.100, 000/to the victim, whose human rights had been infringed due to lackadaisical behavior of the PTI teacher. The State Government is at liberty to recover the amount from the accused PTI teacher. Plight of the school children swimming across bridgeless river to reach to the school of Kaneri Village of District Junagadh (Gujarat) (Case No. 1344/6/12/2014) i. The Commission received a complaint from Shri Pankaj Buch, Convener, Ground Reality Foundation drawing the attention of the Commission towards the plight of the school children swimming across bridgeless river to reach to the school of Kaneri Village of District Junagadh (Gujarat). It is alleged in the complaint that in the absence of a bridge over the river Rupen, the school children of Village Kaneri and other members of 50-60 families of the Village had to swim across the river to go to the school or other places. ii. The Commission called for a report from the Chief Secretary, Govt. of Gujarat. iii.
