errant employer before the appropriate courts. The Under Secretary, Home Department,
Govt. of Jharkhand has submitted that the Government was in close coordination with
their counterparts in Delhi and that benefits to the victim under Social Welfare legislation
have been extended. A similar report was also received from District Magistrate cum
Deputy Commissioner, Gumla, Jharkhand.

The Commission again considered the matter on 25.02.2019 when it closed the case with
observation that:“Appropriate action has already been taken by the concerned state authorities. The errant
employer convicted and sentenced under the provisions of the Bonded Labour System
(Abolition). The victim had also been rehabilitated under the new Central Sector Scheme
and an amount of Rs.1 lakh paid towards his rehabilitation. Benefits under Social Welfare
legislation, as such no further intervention by the Commission in the matter is called for.

Exploitation of bonded labour by the brick kiln owner at Arniwala, District Fazilka, Punjab
(Case No. 518/19/21/2015-BL)
i.
The Commission received a complaint from one Jai Singh of an NGO on behalf of Dalip
Singh s/o Hansa Singh resident of Dhani Machchi Ram Lahoriya Shajrana, Tehsil Arniwala,
District Fazilka Punjab alleging that he along with other labourers (4) are being held
as bonded labourers in a brick kiln “Shiv Shambhu” owned by Amit Kumar Singla and
Pankaj Kumar at Arniwala, District Fazilka, Punjab. It was also alleged that they were
being exploited and assaulted by the brick kiln owner and his men. A prayer has been
made for release of their wages and rescue from bondage.
ii.
In response to the directions by the Commission a report was received from the Deputy
Commissioner, Fazilka. Perusal of the same revealed that the errant employer had been
convicted by the Deputy Commissioner, Fazilka and sentenced till rising of the court. An
amount of Rs.1,000/- as fine was also imposed and deposited in the Government treasury.
It was further submitted that an amount of Rs.1 Lakh each had been paid to both the
victims towards their rehabilitation. It was also submitted that action against the errant
public servants who delayed in rehabilitation of the victims was also being taken.

The Commission considered the matter on 19.09.2018 when it observed and directed as
under:“The instant case of bonded labour has ended in conviction and an amount of Rs.1 Lakh has
also been paid to both the labourers under New Central Scheme. Since the requisite action
has already been taken by the State authorities, no further intervention on the part of the
Commission is called for and the case is closed”.
