A. Previously Recommended Issues Issue 1: Ratification of the OPCAT Status 4. Korea has joined 11 of the 18 international human rights treaties and optional protocols including the Convention. However, it has not joined the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (“OPCAT”), which includes site inspections and establishment of national preventive mechanisms. Despite the fact that Korea was elected to the U.N. Human Rights Council (“UNHRC”) in 2006 and has been serving five terms to date (2020), the state is still “in consideration” of joining OPCAT Resolution) and 5. (2015 UNHRC no tangible progress has been confirmed. The NHRCK, on the other hand, stated to sign and ratify OPCAT in 4 April 2006. It also set forth its opinion that the NHRCK is appropriate as a national preventive mechanism being stipulated in Article 17 and 23 of the Optional Protocol, and no legislative action is required for designation.
