effective administrative control and the actions of those non-state actors can be attributed to the state. • Under the international law principles of state responsibility all states must take all reasonable measures to ensure that individuals are not subject to torture or cruel, inhuman or degrading treatment or punishment, including that administered by non-state actors. • Non-state actors remain subject to international and national criminal law with regard to any acts of torture or cruel, inhuman or degrading treatment or punishment committed by them. • Non-state actors will be also responsible for acts of torture committed during armed conflict under the general principles of international humanitarian law. 42
