「CONSTITUTION OF THE REPUBLIC OF KOREA」 Article 83 The President shall not concurrently hold the office of Prime Minister, a member of the State Council, the head of any Executive Ministry, nor other public or private posts as prescribed by Act. Article 84 The President shall not be charged with a criminal offense during his tenure of office except for insurrection or treason. Article 85 Matters pertaining to the status and courteous treatment of former Presidents shall be determined by Act. SECTION 2 The Executive Branch Sub-Section 1 The Prime Minister and Members of the State Council Article 86 (1) The Prime Minister shall be appointed by the President with the consent of the National Assembly. (2) The Prime Minister shall assist the President and shall direct the Executive Ministries under order of the President. (3) No member of the military shall be appointed Prime Minister unless he/she is retired from active duty. Article 87 (1) The members of the State Council shall be appointed by the President on the recommendation of the Prime Minister. (2) The members of the State Council shall assist the President in the conduct of State affairs and, as constituents of the State Council, shall deliberate on State affairs. (3) The Prime Minister may recommend to the President the removal of a member of the State Council from office. (4) No member of the military shall be appointed a member of the State Council unless he/she is retired from active duty.
