B. Implementation of the Convention on the Rights of the Child Ⅰ. General Measures of Implementation of the Convention (Articles 4, 42 and 44 (6)) 1. Reservations 1) Current situation 4. It is welcomed that the Government amended the Civil Code to withdraw the reservation to Article 9, paragraph 3 of CRC in October, 2008. However, the Government has not taken sufficient actions to withdraw its reservation to Article 21 (a) of CRC. The 'full adoption system' mentioned in the Periodic Report requires authorization of the Family Court for a legally effective adoption, while ordinary adoptions are still possible simply on a report basis. 5. The reservation to Article 40 (2) b-v remains effective under the Constitution and the Military Court Act and no review has been made on the relevant national legislation in an effort to withdraw the reservation. Meanwhile, in April 2007, the Government withdrew its reservation to Article 14, paragraph 5 of the International Convention on Civil and Political Rights (Everyone convicted of a crime shall have the right to his conviction and sentence being reviewed by a higher tribunal according to law). 2) Questions 6. What is the reason that the reservations to Article 21 (a) and Article 40 (2) b-v have not been withdrawn?
