entities and organizations or enterprises regardless of their organizational and
legal form and forms of property required information, documents and
materials;
c) to receive explanations from officials and civil servants of public
authorities, local self-governance bodies in villages and settlements (Jamoats),
entities and organizations or enterprises regardless of their organizational and
legal form and forms of property excluding judges on questions that require
clarification in the course of the examination of complaints;
d) to conduct an investigation of the activity of state bodies, local
executive authorities, local self-governance bodies in villages and settlements
(Jamoats), entities, organizations or enterprises regardless of their
organizational and legal form and forms of property independently or jointly
with competent state bodies, officials and public servants;
e) to commission competent state bodies and scientific institutions to
conduct expert research on the issues that need to be clarified in the process of
investigation of a complaint;
2. On matters of his activity the Human Rights Ombudsman shall enjoy
the right of access without delay to leaders and other officials of state bodies,
local self-governance bodies in villages and settlements (Jamoats), entities,
organizations and enterprises regardless of their organizational and legal form
and forms of property, to leaders of public associations, members of the
leadership of officers of military forces and formations, heads of the
administration of places of criminal and administrative detention facilities
located on the territory of the Republic of Tajikistan.
3. The Human Rights Ombudsman shall have the right to participate at
the sessions of Majlisi Milli and Majlisi Namoyandagon of Majlisi Oli of the
Republic of Tajikistan, at the meetings of Government of the Republic of
Tajikistan and other governmental bodies.
Article 13. Right of the Human Rights Ombudsman to conduct
examinations on his own initiative
1. Upon receiving of the information about mass or gross violation of
rights and freedoms of a person or citizen, or in cases which have special
public importance or in cases related with necessity to protect interests of
people who unable to use legal means of protection independently, the Human
Rights Ombudsman shall have the right to take appropriate measures within
his competences on his own initiative.
