or other reasons over the course of a long time (no less than four months in
succession) or because he moved from the Republic of Tajikistan to another
country for permanent residence.
3. In the case of early dismissal of the Human Rights Ombudsman from
his post, a new Human Rights Ombudsman shall be appointed by the
President of the Republic of Tajikistan upon agreement of Majlisi
Namoyandagon of Majlisi Oli of the Republic of Tajikistan in the course of
two months from the day of early dismissal of the previous Human Rights
Ombudsman from his post in accordance with the procedures established by
the present Law.
CHAPTER III
COMPETENCE OF THE HUMAN RIGHTS OMBUDSMAN
Article 11. Main functions of the Human Rights Ombudsman
1. Main functions of the Human Rights Ombudsman shall be provision
of assistance to ensure:
1) respect for human rights and freedoms of a person and citizen;
2) restoration of violated rights of a person and citizen;
3) improvement of legislation of the Republic of Tajikistan in the field of
human rights and freedoms of a person and citizen;
4) legal education in the field of protection of rights and freedoms of a
person and citizen, forms and methods of its protection;
5) cooperation between public bodies of the Republic of Tajikistan on
protection of rights and freedoms of a person and citizen;
6) development and coordination of international cooperation in the field
of protection of rights and freedoms of a person and citizen.
2. With the aim of fulfillment of his main functions, the Human Rights
Ombudsman shall collect and analyze information received from public
authorities, local self-governance bodies in the villages and settlements
(Jamoats), entities, organizations and enterprises regardless of their
organizational and legal form and forms of ownership, mass media.
Article 12. Competences of the Human Rights Ombudsman
1. While carrying out the investigation of complaints the Human Rights
Ombudsman shall have the right:
a) to visit without obstruction local public authorities, local selfgovernance bodies in villages and settlements (Jamoats), entities and
organizations or enterprises regardless of their organizational and legal form
and forms of property, public associations and military bases, criminal
punishment institutions and other military forces located on the territory of
the Republic of Tajikistan;
b) to request and receive from officials and civil servants of public
authorities, local self-governance bodies in villages and settlements (Jamoats),
