o ensure that whenever a control order is imposed in relation to a
person under 18 years of age, any obligations, prohibitions and
restrictions imposed constitute the least interference with the child’s
liberty, privacy or freedom of movement that is necessary in all the
circumstances
o amend national security laws so that the best interests of the child is:
▪ a primary consideration at all stages in proceedings relating to
the potential issue of an interim or confirmed control order
▪ not made subject to any higher order ‘paramount
consideration’.
o amend the Crimes Act 1914 (Cth) so that minimum non-parole periods
do not apply to children
o amend the Crimes Act 1914 (Cth) so that presumptions against bail for
persons accused of certain Commonwealth offences do not apply to
children.
Aboriginal and Torres Strait Islander children
•
Australian Governments should commit to targets to overcome the health
disadvantage experienced by Aboriginal and Torres Strait Islander children
(including child mortality, ear disease, obesity, mental health and sexual
health) and adopt special measures to address the disparities in the
enjoyment of rights, with the effective engagement of their communities, as
part of the Closing the Gap Refresh process.
•
The Australian Government should commit to a national statistical profile of
ear disease and associated hearing loss for Aboriginal and Torres Strait
Islander children based on diagnostic assessment.
•
The Australian Government should support Aboriginal controlled
organisations and, where appropriate, their partners, to develop and
implement a comprehensive sexual health education strategy for children
and young people.
•
The Australian Government should include education and prevention
programs directed at younger children under the Fourth National Sexually
Transmissible Infections Strategy 2018–2022.
