Article 34. Every person shall be considered innocent until his guilt in committing a crime is proved based on the law and established by a court verdict that has entered into legal force. No one shall be obliged to prove his innocence. Any doubts about guilt that cannot be eliminated shall be resolved in favour of the accused. Article 35. Each individual shall have the right for freedom and personal inviolability. A person may be subjected to criminal punishment only if he was found guilty and convicted by a court in accordance with the procedure established by law. Article 36. No one can be subjected to repeated criminal prosecution and convicted for the same crime. Article 37. Everyone shall have the right to inviolability of privacy, personal and family secrets and their protection from arbitrary interference, as well as from violations of the rules of secrecy of correspondence, telephone conversations and other communications. Article 38. The collection, storage, use and dissemination of information about a person’s personal life without his consent shall not be allowed. State authorities, local self-government bodies, and their officials shall be obliged to provide everyone with the opportunity to familiarize themselves with documents and materials directly affecting their rights and freedoms, unless otherwise provided by law. Article 39. Every citizen shall have the right to move freely and choose his place of residence within Turkmenistan. Restrictions on entry into certain territories, movement through these territories can be established only based on the law. Article 40. The family, motherhood, fatherhood and childhood shall be protected by the state. Upon reaching the age of marriage, a man and a woman shall have the right to marry and start a family by mutual consent. Spouses shall be equal in family relations. Parents or persons replacing them shall have the right and duty to raise children, take care of their health, development, education, prepare them for work, and instil in them a culture of respect for laws, historical and national traditions. Adult children shall be obliged to take care of their parents and provide them with assistance.
