2 2. Issues of Examination There are 4 issues that need to be considered as follows: 1. The use of state power to control and supervise assemblies 1.1 Whether State’s management and supervision of assemblies has acted or neglected any act that can be considered a human rights violation. 1.2 Whether the use of force by government officials during assemblies is an act or a neglecting of an act that can be considered a violation of human right. 1.2.1) The use of crowd control equipment against protesters 1.2.2) The use of force to arrest protesters 1.3 Whether judicial proceedings by government officials involves any act or neglecting of an act that can be considered a human rights violation. 1.3.1) The use of restraining orders and detentions 1.3.2) Notifying an arrested or accused person of their rights 1.3.3) Allegations and offenses 1.3.4) Temporary release 2. Opinions on the exercising of rights and freedom of assembly 3. Opinions on impacts and remedies. 4. Opinions related to child protection during assemblies 3. Outcome of the Examination 1. The Emergency Decree on Public Administration in Emergency Situation B.E. 2548 (2005) that prohibits the assembly or gathering of persons at any place or the commission of any act which may cause unrest has been imposed during protest gatherings to prevent the outbreak of the COVID-19 pandemic.
