14 (4) In this section, “hate speech” means an expression in whatever form that encourages, or has the effect of encouraging discrimination on a ground listed or prescribed under section 26. Freedom of assembly 18.—(1) Every person has the right, peaceably and unarmed, to assemble, demonstrate, picket and to present petitions. (2) To the extent that it is necessary, a law may limit, or may authorise the limitation of, the right mentioned in subsection (1)— (a) in the interests of national security, public safety, public order, public morality, public health or the orderly conduct of elections; (b) for the purpose of protecting the rights and freedoms of others; or (c) for the purpose of imposing restrictions on the holders of public offices. Freedom of association 19.—(1) Every person has the right to freedom of association. (2) A law may limit, or may authorise the limitation of, the right mentioned in subsection (1)— (a) in the interests of national security, public safety, public order, public morality, public health or the orderly conduct of elections; (b) for the purpose of protecting the rights and freedoms of others; (c) for the purpose of imposing restrictions on the holders of public offices; (d) for the purpose of regulating trade unions, or any federation, congress, council or affiliation of trade unions, or any federation, congress, council or affiliation of employers; (e) for the purposes of regulating collective bargaining processes, providing mechanisms for the resolution of employment disputes and grievances, and regulating strikes and lockouts; or (f) for the purpose of regulating essential services and industries, in the overall interests of the Fijian economy and the citizens of Fiji. Employment relations 20.—(1) Every person has the right to fair employment practices, including humane treatment and proper working conditions. (2) Every worker has the right to form or join a trade union, and participate in its activities and programmes.
