any surplus Gifts, Deductible Contributions, or money received by the Forum
because of such Gifts or Deductible Contributions, remaining after payment of all
liabilities, must be transferred to an institution or fund that complies with clause 8
and is an endorsed deductible gift recipient.
(b) Where the Forum operates more than one fund for which it is a deductible gift
recipient and its endorsement under Subdivision 30 BA of the ITAA 97 is revoked
only in relation to one of those funds then it may transfer any surplus assets of that
fund after payment of all liabilities to any other fund for which it is endorsed as a
deductible gift recipient.
10. Altering this constitution
(a)
Subject to clause 10(c) and (d), this constitution may only be amended by special
resolution of the ‘A’ accredited members of the Forum.
(b)
The ‘A’ accredited members must not pass a special resolution that amends this
constitution if passing it causes the Forum to no longer be a charity.
(c)
Any modification of this constitution takes effect on the date the special resolution
is passed or any later date specified, or provided for, in the resolution.
(d)
A special resolution making a material alteration to, or materially affecting, rules
14.1(d) or (e) has no effect unless approved in writing by all of the ‘A’ accredited
members.
11. Forum Membership
11.1
11.2
Membership and Categories of Membership
(a)
The members at the date of adoption of this constitution and any person the Forum
councillors admit to membership under rules 11.2 and 11.3 are the members of the
Forum.
(b)
There are two categories of membership of the Forum: ‘A’ accredited members;
and ‘B’ accredited members.
‘A’ accredited members
(a) Qualifications of ‘A’ accredited members
Each ‘A’ accredited member must be a national human rights institution in the Asia
Pacific region which in the opinion of the Forum councillors complies with the Paris
Principles. Accreditation by the Global Alliance of National Human Rights
Institutions as an ‘A’ status national human rights institution may be taken as
evidence of compliance with the Paris Principles.
(b) Admission of ‘A’ accredited members
(1) The Forum councillors may admit any institution, meeting the qualifications set
out in rule 11.2(a), to ‘A’ accredited membership of the Forum.
(2) Every application for ‘A’ accredited membership must be:
