3. Non-discrimination against, guarantee of human
rights of migrant workers at workplaces
A. Current status and problems
• Migrant workers are exposed to human rights infringement, including frequent
harsh remarks or violence, at workplaces. They are discriminated from local
workers in the nature of works assigned as well as in terms of pay (i.e., wage,
bonus, allowance, etc.), recess hours, and other working conditions. Such matters
require the government’s positive involvement for remedial action.

norms
- Concerning the protection of aliens under domestic laws, Article 6
(Effectuation of Treaties and International Laws and Guarantee of
Aliens’ Status) of the Constitution and Article 4 (About Foreigners in
Republic of Korea) of the National Human Rights Commission Act
apply.
- Regarding the prohibition of employers’ discrimination or violence
against migrant workers, Article 6 (Equal Treatment) and Article 8
(Prohibition of Violence) of the Labor Standards Act apply. The legal
basis for punishment of acts of discrimination is Article 49 (Punishment
