3. Destructive arson resulting in death If, as a consequence of the commission ofanyof the acts penalized underthis Article, death results, the mandatory penalty of death shall be imposed. (Sec. 10) 4. Rape with the victim becominginsane, rape with homicide and qualified rape When by reason or on the occasion of the rape, the victim has becomeinsane, the penalty shall be death. When by reason or on the occasion of the rape, a homicide is committed, the penalty shall be death. The death penalty shall also be imposed if the crime of rape is committed with any of the following attendant circumstances: e Whenthe victim is under eighteen (18) years ofage and the offenderis a parent, ascendant, step-parent, guardian, relative by consanguinity oraffinity within the third civil degree, or the common-lawspouse ofthe parent ofthe victim; e Whenthe victim is underthe custodyofthe police or military authorities; e Whenthe rape is committed in full view of the husband, parent, anyof the children orotherrelatives within the third degree of consanguinity; e Whenthe victimis a religious or a child belowseven (7) years old; e Whenthe offender knowsthat he is afflicted with Acquired Immune Deficiency Syndrome (AIDS) disease; e When committed by any memberof the Armed Forces of the Philippines or the Philippines National Police or any law enforcement agency; e Whenby reasonor on the occasion ofthe rape, when the victim has suffered permanent physical mutilation.
