There are numerous international instruments that create obligations on the
state to prevent violence and discrimination based on gender identity and sexual
orientation. Referring to international customary human rights laws - the Universal
Declaration of Human Rights (UDHR), International Covenant on Civil and Political
Rights (ICCPR) and International Covenant on Economic, Social and Cultural
Rights (ICESCR) have strongly stated the non-discrimination and protection of
individual rights which include all human beings. Therefore, the principle of nondiscrimination is a cross cutting component in major international human rights
laws. This also extend to other human rights mechanism including charter based
mechanisms such as the Human Rights Council and Special Procedures.
