(g) bonded labour system: means a system of forced or partly forced labour under which a debtor enters into an agreement with the creditor in consideration of advance obtained by him and/or for other reasons. S.4: Bonded Labour system stood abolished from the commencement of this Act.20 4. The Transplantation Of Human Organs And Tissues Act, 1994 The Act makes provision for the removal of human organs without authority, for commercial dealings in human organs, for illegal dealings in human tissues etc. 5. National Investigation Agency (Amendment) Act, 2019 NIA Act, 2008 was amended in 2019. The amended Act empowered the Agency to investigate offences related to human trafficking. It further empowered the Agency to investigate such offences on foreign soil subjected to international treaties and domestic laws. 22 Convention on the Elimination of All Forms of Discrimination Against Women Gaps in the implementation of CEDAW in India (G) and its corresponding recommendations (R) compensation to victims as per Central Sector Rehabilitation Scheme. G5: States lack monitoring and regulating systems to prevent fake and fraudulent placement agencies due to which domestic workers get trafficked into commercial sexual exploitation and forced labour. (CEDAW A.6) R5: The State Parties should put in place adequate monitoring and regulating systems to closely monitor the functioning of private placement agencies to prevent trafficking. G6: The Transplantation of Human Organs and Tissues Act, 1994 is presently not aligned with the trafficking of persons. As a matter of fact, persons are also trafficked for the purpose of organ trade. (CEDAW A.6)
