Version as at 1 July 2024 Human Rights Act 1993 Part 1 s 5 (2) The Commission is a Crown entity for the purposes of section 7 of the Crown Entities Act 2004. (3) The Crown Entities Act 2004 applies to the Commission except to the extent that this Act expressly provides otherwise. (4) Despite anything in any other Act, the powers of the Commission under sec‐ tions 16 and 17 of the Crown Entities Act 2004 may be exercised only— (a) by persons authorised by or under this Act or the Crown Entities Act 2004 to perform functions of the Commission, for the purposes of per‐ forming those functions; or (b) by the Director of Human Rights Proceedings, his or her alternate, or the staff of the Office of Human Rights Proceedings (acting in accordance with directions issued by the Director or his or her alternate), for the purposes of exercising or performing a function, power, or duty of the Director under this Act. Functions and powers of Commission Heading: substituted, on 1 January 2002, by section 5 of the Human Rights Amendment Act 2001 (2001 No 96). 5 Functions of Commission (1) The primary functions of the Commission are— (2) (a) to advocate and promote respect for, and an understanding and apprecia‐ tion of, human rights in New Zealand society; and (b) to encourage the maintenance and development of harmonious relations between individuals and among the diverse groups in New Zealand society; and (c) to promote racial equality and cultural diversity; and (d) to promote equal employment opportunities (including pay equity); and (e) to promote and protect the full and equal enjoyment of human rights by persons with disabilities.
