๓.๓.๙ สิทธิอุทธรณ์คดีละเมิดอานาจศาล
กรณีการละเมิดอานาจศาลทางอาญานั้น เมื่อคาตัดสินเป็นที่สุดแล้ว ผู้ที่ได้รับผลกระทบสามารถอุทธรณ์
คาสั่งดังกล่าวได้ทันทีทันใด ทั้งนี้ เป็นไปตาม มาตรา ๓๗๓๑ แห่งประมวลกฎหมายสหรัฐอเมริกา๑๒๒ ส่วนกรณีการ
ละเมิดอานาจศาลทางแพ่งนั้นคู่ความสามารถอุทธรณ์ได้เช่นกัน
๓.๓.๑๐ อานาจของประธานาธิบดีในการอภัยโทษในความผิดฐานละเมิดอานาจศาล
ครั้งหนึ่งเคยมีคดีขึ้นสู่ศาลสูงสหรัฐอเมริกาโดยมีข้อสงสัยว่า ประธานาธิบดีสหรัฐอเมริกามีอานาจให้อภัย
โทษแก่ผู้ที่กระทาความผิดฐานละเมิดอานาจศาลหรือไม่ และการใช้อานาจของประธานาธิบดีดังกล่าวถือเป็นการ
แทรกแซงอานาจตุลาการซึ่งได้รับความคุ้มครองความมีอิสระตามรัฐธรรมนูญหรือไม่ ซึ่งศาลสูงสหรัฐอเมริกาได้
ตัด สิ น ในคดี Ex Parte Grossman๑๒๓ว่ าประธานาธิ บดี มี อานาจให้ อ ภั ยโทษได้ โดยผู้ พิ พากษาอ้ างว่ า
พระมหากษัตริย์ของสหราชอาณาจักรเคยทรงใช้พระราชอานาจให้อภัยโทษแก่ผู้กระทาความผิดฐานละเมิดอานาจ
ศาลมาก่อน และแม้ในสหรัฐอเมริกาเอง ประธานาธิบดีสหรัฐอเมริกาก็เคยใช้อานาจนี้มาหลายครั้งแล้ว นอกจากนี้
การลงโทษฐานละเมิดอานาจศาลนั้น ทาให้ผู้ถูกลงโทษไม่ได้รับการพิจารณาคดีโดยลูกขุน จึงมีเหตุผลพิเศษที่ทาให้
ประธานาธิบดีต้องมีอานาจให้อภัยโทษเพื่อเป็นการหลี กเลี่ยงการลงโทษโดยผิดพลาด หรือมีอคติ หรือ ใช้โทษที่
รุนแรงโดยไม่จาเป็นซึ่งอาจเกิดขึ้นได้
anything herein or in any other provision of law be construed to deprive courts of their power, by civil contempt proceedings,
without a jury, to secure compliance with or to prevent obstruction of, as distinguished from punishment for violations of, any
lawful writ, process, order, rule, decree, or command of the court in accordance with the prevailing usages of law and equity,
including the power of detention”.

18 U.S. Code § 3731 - Appeal by United States
"In a criminal case an appeal by the United States shall lie to a court of appeals from a decision, judgment, or order
of a district court dismissing an indictment or information or granting a new trial after verdict or judgment, as to any one or
more counts, or any part thereof, except that no appeal shall lie where the double jeopardy clause of the United States
Constitution prohibits further prosecution.
An appeal by the United States shall lie to a court of appeals from a decision or order of a district court suppressing
or excluding evidence or requiring the return of seized property in a criminal proceeding, not made after the defendant has
been put in jeopardy and before the verdict or finding on an indictment or information, if the United States attorney certifies to
the district court that the appeal is not taken for purpose of delay and that the evidence is a substantial proof of a fact material
in the proceeding.
An appeal by the United States shall lie to a court of appeals from a decision or order, entered by a district court of
the United States, granting the release of a person charged with or convicted of an offense, or denying a motion for revocation
of, or modification of the conditions of, a decision or order granting release.
The appeal in all such cases shall be taken within thirty days after the decision, judgment or order has been rendered
and shall be diligently prosecuted.
The provisions of this section shall be liberally construed to effectuate its purposes”.
